Acceptance & eligibility

Effective 1 August 2026. By downloading, installing or using EatCam (the "Service", operated by an individual developer; Whaloom is the publishing brand), you agree to be bound by these Terms; if you do not agree, stop using and uninstall the app. You must be of legal age to enter digital-service contracts in your jurisdiction, or use the Service with guardian consent.

The service

The Service performs AI-based dish recognition and nutrition estimation on meal photos, and provides an on-device food diary. All calorie and nutrition figures are algorithmic estimates provided "as is" and "as available", without warranty of any kind.

⚠️ Not medical advice

Calories, macronutrients and daily targets shown by the Service are reference information only. They are not medical, nutritional or health advice and do not substitute for the judgment of a licensed physician, registered dietitian or other professional. If you have a medical condition, take medication, are pregnant or nursing, are a minor, or have a history of disordered eating, use the Service only under professional guidance. Weight-management features of the Service are not promoted to minors. Dietary decisions you make based on the Service are at your own risk.

Subscriptions, billing & refunds

EatCam Pro is an auto-renewing subscription: US$5.99/month or US$29.99/year with a 7-day free trial, charged through the platform you downloaded the app from (Apple App Store or Google Play). It renews automatically unless cancelled at least 24 hours before the end of the current period (iOS: Settings → Apple ID → Subscriptions; Android: Google Play → Payments & subscriptions). Price changes follow the respective platform's rules, with advance notice and, where required, your consent. Refunds are handled solely by the platform under its policies; started periods are generally not refunded pro rata.

Free quota & acceptable use

The free tier includes a limited number of photo recognitions per day, refreshed daily; we may reasonably adjust the quota with notice. Abusing the quota or interfering with the Service — through scripts, automation, or multi-device manipulation — is prohibited and may result in suspension or termination.

Your content & licence

Photos you take and data you enter remain yours. To provide recognition, you grant us a temporary, non-exclusive licence to process uploaded photos solely for that purpose (deleted after processing — see the Privacy Policy). You agree not to upload unlawful or infringing content, or content containing others' personal information.

Intellectual property

The Service's software, interface design, illustrations, trademarks (EatCam, Whaloom) and dish-nutrition database belong to the operator and are protected by copyright, trademark and other laws. No part of the Service may be copied, modified, reverse-engineered, scraped, rented or redistributed without written permission.

Disclaimer

To the maximum extent permitted by law, we do not warrant the accuracy, completeness or fitness of recognition results, nor uninterrupted or error-free operation. Your diary data is stored only on your device: we are not liable for data loss caused by device loss, damage, system restore or absent backups (enabling your system cloud backup — iCloud on iOS or Google Backup on Android — is recommended).

Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special, punitive or consequential damages. Our total liability arising from the Service is capped at the subscription fees you actually paid us in the 12 months preceding the claim, or US$10 for non-paying users. Where such limitations are not permitted, they apply to the fullest extent allowed.

Termination, changes & contact

You may stop using and uninstall the Service at any time; we may suspend or terminate access for material breach of these Terms. We may update these Terms from time to time; material changes will be announced in-app and continued use constitutes acceptance. The English version of these Terms is authoritative.
